These Terms and Conditions (“Terms”) govern your use of Growdie (“App”), a growth and development app that provides tools for planning, tracking progress, engaging with a social feed, participating in a points and leaderboard system, and accessing a chat feature. By subscribing to and using the App, you agree to abide by these Terms.
1. Acceptance of Terms
By downloading, subscribing to, or using Growdie, you agree to be bound by these Terms and conditions. If you do not agree with any part of these Terms, please do not use our App.
2. Subscription and Payment
- Subscription Fees: The App requires a subscription fee of $9.99 per month, processed through the Apple App Store. Alternatively, a $99.00 annual subscription fee is also an option from which you can select. This annual subscription auto renews and is processed via the Apple App Store.
- 1-Month Free Trial: New users are eligible for a one-time, free 21-day trial. After the trial period ends, the subscription will automatically begin at the standard rate of $9.99 per month unless canceled at least 24 hours before the trial concludes. If you cancel during the trial period, you will not be charged.
- Auto-Renewal: Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period or trial period. The renewal fee will be the same as the initial subscription fee, unless notified otherwise.
- Payment Processing: All payments are managed by the Apple App Store, and your payment method will be charged accordingly. Apple’s payment policies govern payment processing, and we do not directly store or process payment information.
- Refund Policy: Refund requests must comply with Apple’s refund policy. As such, this App does not offer refunds directly and defers to Apple for all refund inquiries and resolutions.
4. User Responsibilities
By using this App, you agree to the following:
- Use the App for Personal Development Purposes: You will not use Growdie for any illegal or unauthorized purposes, including harassment, impersonation, or sharing content that violates third-party rights and/or Apple's policy.
- Respect Community Guidelines: Cease from posting offensive, inappropriate, or harmful content. We reserve the right to remove content and restrict access to users who violate the guidelines.
- Account Security: You are responsible for maintaining the confidentiality of your account login information and are responsible for all activities under your account.
5. Content and Intellectual Property
- Ownership of Content: All content within the App, including designs, trademarks, and code, is the exclusive property of Growdie and/or its licensors. Unauthorized copying, redistribution, or commercial use is prohibited.
- User-Generated Content: By posting or sharing content on the App, you grant Growdie a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content. Growdie has the right, but not the obligation, to monitor and remove user content.
- Feedback and Suggestions: Any feedback, ideas, or suggestions provided by you regarding Growdie may be used by us without compensation or attribution.
6. Termination and Suspension
Growdie reserves the right to suspend or terminate your account or access to the App at any time, without prior notice or liability, if we believe you have violated these Terms, any applicable law, or if required by Apple’s App Store guidelines.
7. Disclaimer of Warranties
- “As-Is” Basis: Growdie is provided on an “as-is” and “as-available” basis, without any warranty of any kind. We make no warranties regarding the accuracy, reliability, or completeness of content or services within the App.
- Limitation of Liability: To the fullest extent permitted by law, Growdie and its affiliates, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the App or inability to use it.
8. Limitation of Liability
Growdie’s liability to you is limited to the amount you paid for your most recent subscription period. To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages, including but not limited to loss of data, loss of profit, or personal injury.
9. Indemnification
You agree to indemnify, defend, and hold harmless Growdie and its affiliates, officers, directors, employees, agents, and licensors from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your use of the App, any content you post, or your violation of these Terms.
10. Apple App Store Terms
- Acknowledgement: You acknowledge that these Terms are between you and Growdie, not Apple. Growdie is solely responsible for the content and operation of the App.
- Apple’s Limited Warranty: To the extent that Apple provides any warranty, it is limited to any refunds Apple may issue for the purchase price of the subscription. Growdie disclaims all other warranties.
- Maintenance and Support: Growdie is responsible for the maintenance and support of the App. Apple has no obligation to provide maintenance or support services.
- Third-Party Claims: Growdie, not Apple, is responsible for addressing claims related to intellectual property infringement, product liability, and compliance with legal or regulatory requirements, including consumer protection.
11. Amendments and Modifications
Growdie may modify these Terms from time to time. Changes will be effective upon posting in the App or on our website. Continued use of the App after any modifications indicate acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Growdie operates, excluding its conflict of law principles.
